Often some court proceeding is required when the deed is still in the deceased owner's name alone and there is no trust or recorded transfer-on-death deed, because a buyer's title company will want a court order or letters showing who has authority to sign. Which proceeding applies depends on the estate, so the attorney reviews the deed and the family situation before anyone signs a contract.
Does a transfer-on-death deed avoid probate in Oklahoma?
A properly recorded transfer-on-death deed passes the property outside probate, but Oklahoma law requires the beneficiary to record an acceptance affidavit with the death certificate within nine months of the owner's death, or the property reverts to the estate (58 O.S. Section 1252). The attorney can prepare the deed, or the acceptance, and confirm the deadline for your situation.
